How the offer works:

When you purchase a 12-month rolling subscription to Prospect you will pay by direct debit (available in the UK only) or by continuous credit/debit card payment.

If you correctly predict which party will control the Senate after the 2018 midterm elections, we will send you a cheque within 28 working days of the election to refund your first year’s subscription cost in its entirety. We will send an email to you when your cheque has been posted.

After receiving your first year, your subscription will renew automatically every 12 months at the same price you pay today. If the price changes, we will notify you in advance of the next payment being taken. You are free to cancel at any time by notifying us and are always protected by our money-back guarantee.

We can only accept one subscription per household. Excludes Northern Ireland. Offer closes midnight Monday 5th November and is subject to the full terms and conditions below.

1. The promoter
The promoter is: Prospect Publishing Limited (Prospect), 2 Queen Anne’s Gate, London, SW1H 9AA

2. The competition
2.1 The title of the competition is US midterm elections—who will control the Senate prediction.
2.2 New subscribers to Prospect can choose whether they think Republicans or Democrats will have a majority in the United States Senate after the 2018 midterm elections. If they choose correctly, their first year’s subscription payment will be refunded.

3. How to enter
3.1 The competition will run from 08:30 on 30th October 2018 (the “Opening Date”) to 23:59 on 5th November 2018 (the “Closing Date”) inclusive.
3.2 All entries must be received by the Promoter by no later than 00:00 on 6th November 2018. All competition entries received after the Closing Date are automatically disqualified.
3.3. The competition is limited to the first 250 respondents.
3.4 To enter the competition take a subscription to Prospect magazine by direct debit (UK only) or by continuous credit/debit card using the relevant weblink provided in the promotional email. By clicking the relevant link you are deciding whether you think the Republicans or Democrats will have a majority in the United States Senate after the 2018 midterm elections. This must be done by 23:59 on 5th November 2018. Once you have submitted your entry it cannot be changed.
3.5 The purchase of a subscription by direct debit (UK only) or by continuous credit/debit card is necessary.
3.6 The Promoter will not accept responsibility for competition entries that are lost, mislaid, or delayed, regardless of cause, including, for example, as a result of equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind;
3.7 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

4. Eligibility
4.1 The competition is only open to persons aged 18 years or older, with the following exceptions:
(a) employees of the Promoter or its holding or subsidiary companies;
(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration.
(c) members of the immediate families or households of (a) and (b) above; or
(d) residents of Northern Ireland.
4.2 In entering the competition, you confirm that you are eligible to do so
4.3 The Promoter will not accept competition entries that are:
(a) automatically generated by computer;
(b) completed by third parties;
(c) completed in bulk; or
(d) incomplete.
4.4 There is a limit of one entry to the competition per household.
4.5 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

5. The prize
5.1 The prize is a year’s free subscription to Prospect if the result of the US midterm elections is predicted correctly.
5.2 There is no cash alternative for the prize.
5.3 The prize is not negotiable.

6. Winner announcement
6.1 After the result of the elections, those who correctly predicted the outcome will be notified by email.

7. Claiming the prize
7.1 Cheques will be despatched to those who correctly predicted the outcome of the US midterm elections, within 28 days of the result being known.
7.2 Cheques will bear the name of the competition entrant.
7.3 The prize may not be claimed by a third party on your behalf.

8. Limitation of liability
8.1 Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

9. Ownership of competition entries and intellectual property rights
9.1 The Promoter does not claim any rights of ownership in your competition entry.

10. Data protection and publicity
10.1  Your details will be processed by Prospect and our suppliers in full accordance with UK data protection legislation and our Privacy Policy, available here https://prospectmagazine.co.uk/privacy-policy.
10.2 By entering the competition, you agree that any personal information provided by you in the competition entry may be held and used by the Promoter its agents and suppliers to administer the competition.

11. General
11.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.
11.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
11.3 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
